FIFA Disciplinary Committee announced on the official website a disciplinary decision on Chinese football on November 3 last year.
Liaoning Shenyang City needs to inherit a debt of about 19,000 euros left by the disbanded Liaoning Football Club.
This judgment subverts the normal understanding of many people, and it is very vigilant for Chinese clubs.
This debt should belong to the joint mechanism compensation of the former Liaozu foreign aid Gustavo.
According to the relevant regulations of FIFA, when Liaozu spends a transfer fee to introduce Gustavo, the Brazilian Gremio Osasco Dreadnought team he played for in his early years will be entitled to a certain percentage of compensation from the joint mechanism.
But the Liaoning Football Club did not pay the fee, and with the disbandment of the team, the Brazilian team has not received the money.
For this reason, the creditors sued another team named “Liaoning” Liaoning Shenyang City to FIFA, requiring the team to inherit the debt of Liaozu.
From our conventional point of view, this approach is a bit “nonsensical”. Liaozu and New Liaozu are obviously two different teams.
During the existence of Liaozu, the city of Shenyang, Liaoning, existed under the name of “Shenyang Urban Construction”.
The two parties are not only two different industrial and commercial entities, but also two registered entities in the Chinese Football Association.
After the disbandment of Liaozu, the prefix of Liaoning is more representative of a kind of “feeling”, but it is because of this “feeling” that the team is inexplicably involved in the lawsuit.
For this reason, FIFA conducted a detailed evidence collection inquiry to the Chinese Football Association, although the Chinese Football Association endorsed that the two clubs did not constitute an inheritance relationship.
But FIFA still announced the above verdict.
FIFA believes that judging the club’s debt inheritance should not be determined entirely by law, but should also take into account the team’s name, headquarters, main colors, jerseys, logos, stadiums, players, investors, public information and many other aspects. This is stated in the 2019 edition.
It has been clarified in the Disciplinary Guidelines (Article 15, Point 4, Disciplinary Guidelines 2019 Edition).
Shenyang City, Liaoning, explained this in detail. For example, when the jersey was changed to red and black and white, Liaozu also existed at the same time, the name was added to Liaoning because of the neutral name policy, the collective transfer of 28 players mainly accepted echelon players, and the flag presentation ceremony, etc.
In order to pay tribute to the memory of Liaozu and so on.
However, FIFA insists that, in accordance with Article 15 of the 2019 Disciplinary Guidelines, based on a comprehensive analysis of multiple elements, Liaoning Shenyang City meets the criteria for inheriting Liaozu’s debts.
In particular, the official public flag-giving ceremony of “inheriting the Liaozu flag”, the official tribute video and public news reports about “the new Liaozu inheriting the Liaozu flag” are considered to be one of the evidences that the club has publicly inherited the Liaozu.
Of course, if Liaoning Shenyang City refuses to accept the decision, it can continue to appeal to CAS (International Court of Arbitration for Sport).
No more relevant news has been seen so far.
Not only have to pay fines, Liaoning Shenyang city also bears related late fees.
And before the payment is completed, you may be punished by prohibiting the registration of new players, penalty points, or even disqualification from registration.
For many Chinese clubs, this case tells us that it is common to inherit the “feelings” after the dissolution of the old club, but remember not to take over the debt while taking over the “big banner”.
